DOL's Overtime Rule

The Department of Labor (DOL) issued a “request for Information” (RFI) to solicit feedback on its overtime regulation. DOL says it intends to issue a proposed rule in January 2019 and speculation is that the salary threshold in the new proposed rule will be in the $30,000-$35,000 range. The invalidated Obama administration rule that was stayed nationwide in November 2016 would have more than doubled the salary level used to determine whether employees can be classified as exempt from overtime compensation under FLSA, extending overtime pay eligibility to most employees earning less than $913 a week (or $47,476 a year) from $455 per week (or $23,660 a year).
